1. Acceptance of Terms
By accessing or using the Thespian Arts Academy website (the "Site") or enrolling in any of our courses, you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Site or enroll in our courses. These Terms constitute a legally binding agreement between you and Thespian Arts Academy, located at 1680 Vine Street, Los Angeles, CA 90028, and operated by Vance Educational Enterprises, LLC.
2. Course Enrollment and Payment
Enrollment in Thespian Arts Academy courses is subject to availability and acceptance by the Academy. To enroll, you must complete the registration process and pay the required tuition fees. Payment can be made via credit card, debit card, or other methods as specified on the Site. All fees are non-refundable unless otherwise stated in our refund policy, which is detailed in section 5.
The Academy reserves the right to cancel or reschedule courses due to insufficient enrollment or other unforeseen circumstances. In the event of cancellation by the Academy, enrolled students will be offered a full refund or the option to transfer to another available course.
3. User Conduct
You agree to use the Site and participate in courses in a manner that is respectful, lawful, and consistent with the values of Thespian Arts Academy. You are prohibited from engaging in any of the following activities:
- Harassing, threatening, or intimidating other users or instructors.
- Posting or transmitting any content that is defamatory, obscene, or offensive.
- Disrupting the operation of the Site or the conduct of courses.
- Violating any applicable laws or regulations.
- Sharing course materials or content with individuals who are not enrolled in the course.
- Engaging in any form of plagiarism or academic dishonesty.
The Academy reserves the right to suspend or terminate your access to the Site and courses if you violate these conduct guidelines.
4. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Thespian Arts Academy or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or modify any content from the Site without the express written consent of the Academy. Course materials provided to enrolled students are for personal educational use only and may not be shared or distributed without permission.
5. Refund Policy
Thespian Arts Academy's refund policy is as follows: A full refund will be provided if a student withdraws from a course within 7 days of enrollment, provided that the course has not yet begun. After this 7-day period, refunds are subject to a cancellation fee of 25% of the total tuition. No refunds will be issued once a course has commenced, except in cases of documented medical emergencies or other extenuating circumstances, as determined by the Academy administration. All refund requests must be submitted in writing to the Academy's administrative office at [email protected] and are subject to review and approval.
6. Limitation of Liability
To the fullest extent permitted by law, Thespian Arts Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or enrollment in our courses. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses. The Academy's total liability for any claim arising under these Terms shall not exceed the amount of tuition fees paid by you for the course in question.
7. Disclaimer of Warranties
The Site and courses are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Thespian Arts Academy disclaims all warranties, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. The Academy does not warrant that the Site will be uninterrupted or error-free, or that the courses will meet your specific requirements or expectations. We encourage prospective students to attend an information session or speak with a current student prior to enrollment.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
9. Changes to Terms
Thespian Arts Academy reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site or enrollment in courses after the posting of revised Terms constitutes your acceptance of the changes. 11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed replaced by a valid and enforceable provision that most closely reflects the original intent of the parties.
12. Waiver
No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Thespian Arts Academy. The failure of the Academy to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13. Entire Agreement
These Terms constitute the entire agreement between you and Thespian Arts Academy with respect to your use of the Site and enrollment in our courses, and supersede all prior or contemporaneous communications and proposals, whether oral or written.
